Eligibility Criteria for the Magistrate Role

Applicants must meet at least one of the following qualifications:

  • Former post-holder in Andhra Pradesh Judicial Service (retired or resigned)
  • Retired official in the A.P. Judicial Ministerial Subordinate Service (Superintendent rank or higher) with a Law Degree
  • Former Section Officer or above in A.P. High Court Service with a Law Degree
  • Advocate with at least 5 years of experience who is currently not enrolled in the Bar Council
  • Retired Gazetted Officer with Law Degree or who passed the full Criminal Judicial Test or equivalent modern equivalents, and exercised magisterial powers for a minimum of three years

Preference will be given to retired Judicial Officers.

Age Limit

  • Minimum: 45 years
  • Maximum: 65 years (including only those with at least 1.5 years left before reaching 65)

  • Member of any local/state authority or legislature
  • Individuals previously dismissed or removed from service due to misconduct
  • Individuals convicted of crimes involving moral turpitude
  • Individuals with unsound mind or certain health conditions (e.g. leprosy, blindness)
  • Bigamous individuals or those in void marriages
  • Adjudged insolvent or undischarged insolvent
  • Contractors or businesspersons involved in contracts with the local/state/central government

Responsibilities of Special Judicial Magistrate II Class

Once appointed, the Magistrate is expected to:

  • Adhere to all duties assigned under the jurisdiction of II Class Magistrates
  • Attend scheduled court sittings without fail
  • Handle judicial matters per the Criminal Procedure Code or the Bharatiya Nyaya Sanhita, 2023
  • Maintain impartiality, discipline, and avoid conflicts of interest

Failure to attend three consecutive sittings without valid permission may result in termination without notice.

Power & Termination Clauses

  • The powers of the Magistrate automatically cease at age 65
  • If the High Court receives misconduct complaints, the Committee may initiate an inquiry
  • Based on findings, the Government may issue orders for termination without further appeal
